Terms of Service

These Terms govern your use of Psych Today Screener (the "Service"). By creating an account you agree to them. Your handling of Protected Health Information is additionally governed by the Business Associate Agreement.
1. Who can use the Service
You must be a licensed mental-health professional (or operating under one) in the United States. You must be at least 18. You may not use the Service to deliver clinical care — the Service helps you triage intake email, not treat patients.
2. Your account
- You're responsible for keeping your sign-in credentials and TOTP secret confidential.
- You won't share your account with people outside your practice.
- You'll notify us immediately if you suspect unauthorized access.
3. Subscription, trials, and billing
- The Service is offered on a monthly subscription via Stripe.
- 14-day free trial. No card required. We email you a reminder 3 days before trial end.
- You can cancel any time. Cancellation takes effect at the end of the current billing period.
- If a payment fails, we'll retry for up to 7 days, then suspend processing for your tenant until you update your card. Your data is not deleted during suspension.
4. What we provide
- Inbound-email screening, structured extraction, crisis routing, auto-replies, daily digests.
- HIPAA-compliant infrastructure (encryption, audit logs, BAA chain, breach response).
- 99.5% uptime target for the polling pipeline (best-effort; not a refund-bearing SLA in v1).
5. What you must not do
- Use the Service to engage with anyone other than prospective therapy clients.
- Attempt to access another tenant's data, reverse-engineer the encryption, or bypass authentication.
- Send spam through your connected mailbox via the Service.
- Use the Service in a way that violates HIPAA or applicable state law.
6. Clinical responsibility
The Service is a screening tool. It does not provide a clinical diagnosis, treatment plan, or crisis intervention. You remain responsible for clinical judgment, including follow-up on any crisis-flagged email. The crisis auto-reply is a redirect to public resources (988, 911, 741741); it does not constitute clinical care.
We do our best to flag every acute-risk email, but the system is not infallible. You agree to review crisis-flagged intakes promptly and to remain the responsible clinician for any prospective client who contacted your practice.
7. Intellectual property
We retain ownership of the Service, including code, prompts, and UI. You retain ownership of your practice data, including all PHI processed through the Service. We won't use your PHI to train AI models.
8. Termination
You can delete your account at any time (Settings → Delete account). On deletion we crypto-shred your tenant's data encryption key, which renders the encrypted PHI unrecoverable. Audit logs are retained for the HIPAA-required six years.
We can terminate accounts that violate these Terms (e.g., abusive sending, payment fraud, repeated security violations) with notice where practical.
9. Warranty disclaimer
The Service is provided "as is." We disclaim all implied warranties to the extent permitted by law. We do not guarantee that crisis detection will catch every acute-risk case, that the Service will be uninterrupted, or that all bugs will be fixed.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from the Service is capped at the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, incidental, or consequential damages. This cap does not apply to our HIPAA breach-notification obligations under the BAA, which are governed separately.
11. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in New Jersey.
12. Changes
We'll email account owners 30 days before material changes. Continued use after the effective date constitutes acceptance.
